Terms of Service for Pure Comments Hosting

These Terms of Service ("Terms") govern your use of the Pure Comments managed hosting service ("the Service"). By signing up for or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Pure Comments hosting provides:

• Managed hosting of the Pure Comments application.
• Storage of comment data submitted through your website(s).
• Access to an administrative dashboard for moderation and configuration.

The Service is provided on an as-is, best-effort basis.

2. Your Responsibilities

You agree to:

• Use the Service in compliance with all applicable laws.
• Ensure the content submitted to your site does not violate the rights of others.
• Moderate user-generated content on your site.
• Keep your account and login credentials secure.

You are fully responsible for the content your visitors submit through your instance of Pure Comments.

3. Prohibited Use

You must not use the Service for:

• Illegal activities.
• Harassment, abuse, spam, or hate content.
• Hosting high-risk or harmful material, including malware or phishing.
• Automated scraping or misuse of the Service infrastructure.

We may suspend or terminate your account if we believe you are violating this section.

4. Data Ownership

You own all data submitted to your instance of Pure Comments.

We will never:

• Sell your data.
• Share your data with third parties except where legally required.
• Monetise or analyse your data beyond what is required to operate the Service.

You may request a full export or deletion of your data at any time.

5. Backups

We perform regular backups of hosted data as part of normal service operation. However, we cannot guarantee the availability, timeliness, or completeness of backups. You remain responsible for exporting and safeguarding your own data if required.

6. Availability and Changes

We aim to provide stable, continuous service but make no guarantees regarding uptime or performance.

We may update, modify, or discontinue parts of the Service at any time. If changes materially affect users, we will provide reasonable notice.

7. Payment and Billing

If you are using a paid plan:

• Payment is required in advance for each billing cycle.
• Failure to pay may result in suspension or termination of your hosted instance.
• Prices may change, but you will be notified in advance.

8. Termination

You may cancel your account at any time.

We may suspend or terminate your account if:

• You violate these Terms.
• Your use poses a security, legal, or stability risk.
• Continued operation of your instance becomes technically unreasonable.

Upon termination, you may request a data export for a limited time.

9. Liability

To the fullest extent permitted by law:

• The Service is provided without warranties of any kind.
• We are not liable for data loss, downtime, or damages of any kind arising from your use of the Service.
• Our total liability will not exceed the amount you paid for the Service in the previous 12 months.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
